What can be done about an owner who does not pay the dues?
Enforcement proceedings may be commenced for unpaid dues, and the owner may be liable for default interest of up to five per cent per month for the period of delay. Where non-payment persists, the further sanctions provided in the Law may also come into play.
How is a resolution of the owners' assembly challenged?
An owner who attended but voted against may bring an annulment action before the civil court of peace within one month of the resolution; an owner who did not attend has one month from becoming aware of it and, in any event, six months from the date of the resolution.
My neighbour is using a common area without permission. What can I do?
You may apply for the intervention of the judge and bring an action for the prevention of interference. For structures contrary to the approved project, restoration to the original condition may be demanded.
